Settlement for victim of faulty surgery in French clinic

Our client

Our client, Naveeda, was involved in an accident whilst skiing in France and fractured her left wrist. She was taken to a private clinic, yet the surgery had not aligned the fracture, before inserting the pin. There was also concern around the amount of painkillers she had taken and where she had a history of a kidney transplant, certain medication was unsuitable, yet was still prescribed despite this.

It was upon seeking medical attention on her return to the UK that Naveeda was advised that the operation in France had been performed incorrectly. It was strongly advised that she undergo a repeat operation, which was performed a few weeks later.

The process of the claim

Upon identifying the French clinic’s insurer, who would become the defendant in the case, they denied liability and court proceedings were issued to protect Naveeda’s position in her medical negligence claim. Further expert evidence was also obtained to deal with the issue of liability and the standards in France, from a French Lawyer.

Settlement offers were then made, in advance of the Defence being provided and the matter concluded with Naveeda accepting the Defendant’s counter offer. This was a positive outcome that Naveeda was very pleased with and which will assist in moving on from this incident.
